GEMA spokeswoman Ursula Goebel said that Youtube embeddings of copyrighted content should be charged, for example on social networks or on blogs. “Simple hyperlinks are not a relevant usage, without which the Internet would not work, but Embedded Content, where the user is not clear that the file is from a different site, should be licensed,” Goebel said at the request of golem
So it would be fine to share a Youtube link on Facebook as long as users watch the video on Youtube. If, however, an embedding takes place – at Facebook, this usually happens automatically – and the users remain on the social network website, the person responsible for the embedding should be asked to pay. It is unclear in this example whether the user or Facebook should be blamed for embedding.

The situation is also problematic because Youtube already pays fees for copyrighted content to the company for musical performance and mechanical reproduction rights. If such a video is placed on a private website, double licensing fees would be due for a further licensing: for Youtube and the site operator. Goebel was guilty of an answer to the question of how this would be avoided in the future. At present the advance is only a demand. This would not be implemented tomorrow. Finally, the European Court of Justice has to decide.

The EU Commission is currently conducting public consultation with users, authors, publishers, broadcasters and more. The deadline runs until 5 March. A subsequent decision of the EUGH is eagerly awaited. We'll keep you up to date.
